Motorcyclist injured in crash indicted on felony DUI charges

Burlington Twp. man released on $75K personal recognizance bond

ST. CHARLES TOWNSHIP – A Kane County grand jury indicted a Burlington Township man on charges of felony aggravated driving under the influence, according to court records.

The Aug. 28 indictment lists two counts of felony aggravated driving under the influence against Mark A. Barber, 55, of the 8N300 block of Barron Road, Burlington Township near Maple Park.

The two counts state he drove a motorcycle while under the influence and having a blood alcohol content greater than 0.08%, after having committed a similar violation twice before.

The aggravated driving under the influence are Class 2 felonies, punishable by four to seven years in prison and fines up to $25,000 if convicted.

Barber was also indicted on two misdemeanor counts of driving under the influence and driving with a blood alcohol content greater than 0.08%, according to court records.

The misdemeanors are punishable by up to 364 days in jail and fines of up to $2,500, if convicted.

The indictments against Barber stem from an April 8 motorcycle crash in which he was critically injured, according to court records and sheriff’s reports.

Barber was riding a 2010 black Harley-Davidson motorcycle west on Ellithorpe Road from Burlington Road about 9 p.m. April 8 when he veered over the white fog line and into the loose gravel on the side of the road. This caused him to lose control of his motorcycle and crash, according to sheriff’s reports.

Barber was released on a $75,000 personal recognizance bond. The terms of his bond include wearing a SCRAM bracelet. SCRAM stands for secure continuous remote alcohol monitor.

A preliminary hearing for Barber is scheduled for Sept. 12.
